Atlantis Recruitment Brisbane — Candidate Portal Terms and Conditions

These Candidate Portal Terms and Conditions ("Terms") govern your use of the candidate registration portal operated by Atlantis Recruitment Brisbane ("ARB", "we", "us" or "our"). Please read them carefully. By submitting your details through our candidate portal, you agree to these Terms.
1. Who we are and what this portal is
1.1 Atlantis Recruitment Brisbane is a recruitment agency. Our director is Nishant Chand and our registered address is 5013 Mount Lindesay Highway, South Maclean, QLD 4280, Australia.
1.2 Our website is https://atlantisrecruitmentbrisbane.com and our candidate portal is located at https://careers.atlantisrecruitmentbrisbane.com/apply.
1.3 The candidate portal is an intake and registration service. It lets you register your interest in employment opportunities and provide us with information about yourself so that our recruiters can consider you for roles.
1.4 The portal is not a login-based account service. You do not create a username, password or ongoing login. You submit your details once through the registration form, and our recruiters then manage your information internally. Where these Terms refer to your "registration", they mean the details and materials you have submitted to us.
1.5 We recruit for the Corporate and Retail sectors, for role types including business support, admin staff, advisor, store manager and retail assistant.
2. Your registration and keeping your details current
2.1 When you register, you may provide information such as your name, email address, phone number, location, sector of interest, role type, salary expectation, resume/CV, cover letter and a free-text message.
2.2 Because there is no login, you cannot edit your submission yourself after you send it. If your circumstances or contact details change, or you notice an error in what you submitted, please contact us at info@atlantisrecruitmentbrisbane.com and we will update or correct your details.
2.3 You are responsible for the accuracy and currency of the information you give us. Keeping your details up to date helps us match you to suitable opportunities.
2.4 You must only submit your own information and register on your own behalf. Do not register on behalf of another person.
3. Accuracy of the information you provide
3.1 By submitting your details, you warrant that the information you provide is true, accurate, complete and not misleading, and that you have the right to provide it.
3.2 You must not misrepresent your qualifications, work history, right to work in Australia, references, or any other matter relevant to your suitability for employment.
3.3 You must not include the personal information of any other person (for example, a referee, former colleague or family member) unless you have that person's consent to provide it to us for recruitment purposes.
3.4 We rely on the information you provide. Providing false, incomplete or misleading information may result in the removal of your registration and may affect your candidacy with us and our clients.
4. How we use your information for recruitment purposes
4.1 We collect and use your information to provide recruitment services, including to:
- (a) assess your suitability for current and future roles;
- (b) contact you about opportunities and the recruitment process;
- (c) prepare candidate summaries and profiles for the purpose of presenting you to prospective employers;
- (d) match your details against roles for which our clients are recruiting;
- (e) manage our relationship with you and keep records of our recruitment activities; and
- (f) comply with our legal obligations.
4.2 We may retain your information for a reasonable period so that we can consider you for future opportunities, unless you ask us to remove it (see clause 13).
5. Disclosure of your information to prospective employers and our clients
5.1 The purpose of registering is so that we can put you forward for employment. To do that, we may disclose relevant parts of your information — such as your resume, candidate summary, work history, qualifications, role and salary preferences, and contact details — to prospective employers and our subscribing client businesses for the purpose of recruitment.
5.2 We will only disclose your information to prospective employers and clients for legitimate recruitment purposes connected with seeking employment for you.
5.3 Our clients are required, under their own agreements with us, to keep candidate information confidential, use it only for legitimate recruitment, restrict access to it, and not build their own competing databases from it.
5.4 This clause 5 covers disclosure to prospective employers and our own clients for the purpose of placing you. It does not cover disclosure to third-party recruitment firms for a fee, which is dealt with separately in clause 7 and requires your separate express written consent.
6. Communications about opportunities
6.1 By registering, you consent to us contacting you by phone, email and SMS about employment opportunities, your registration, and the recruitment process, in accordance with the Spam Act 2003 (Cth).
6.2 These communications are sent because you have asked us to consider you for employment. We will identify ourselves in our messages and provide a way to opt out of commercial electronic messages.
6.3 You can opt out at any time by using the unsubscribe function in our emails, replying to ask us to stop, or emailing info@atlantisrecruitmentbrisbane.com. We will action opt-out requests promptly. Please note that if you opt out of communications, we may be unable to progress you for opportunities.
7. Disclosure to third-party recruitment firms (separate consent required)
7.1 Sometimes we may not be able to place you ourselves. In that situation, we may be able to help you by passing your information to third-party recruitment firms who may have suitable opportunities.
7.2 We will only disclose your information to third-party recruitment firms if you give us your separate, express, written and signed consent to do so. This is a distinct and optional consent. Your general consent to us using your information to seek employment for you (clauses 4 to 6) does not authorise this, and we will not assume it.
7.3 If you provide that separate consent, it will clearly explain, and you will be agreeing to, the following:
- (a) Nature and purpose of the disclosure — that we may disclose your information to third-party recruitment firms so that those firms can consider you for, and contact you about, employment opportunities they are recruiting for;
- (b) Types of information that may be disclosed — for example your name, contact details, location, resume/CV, work history, qualifications, role and salary preferences, and candidate summary;
- (c) Categories of recipients — third-party recruitment and staffing firms operating in Australia; and
- (d) Commercial benefit to us — that we may receive a fee or other commercial benefit in connection with disclosing your information to, or your placement by, those third-party recruitment firms.
7.4 Giving this consent is entirely voluntary. You can decline it, and you can withdraw it at any time by emailing info@atlantisrecruitmentbrisbane.com (withdrawal does not affect disclosures already made). Declining or withdrawing this consent will not affect our own efforts to place you.
7.5 This clause is supported by our separate consent form and our Privacy Policy. Where there is any inconsistency about third-party disclosure, the separate signed consent you provide will govern the scope of what we are authorised to disclose.
8. Acceptable use of the portal
8.1 When using the portal, you must not:
- (a) provide false, inaccurate or misleading information, or impersonate any person;
- (b) submit the personal information of anyone else without their consent, or submit information you are not entitled to share;
- (c) upload any file containing a virus, malware or other harmful code;
- (d) upload or submit content that infringes any third party's intellectual property, confidentiality or other rights, or that is unlawful, defamatory, discriminatory or offensive;
- (e) use the portal for any unlawful purpose or in any way that could damage, disable or impair it, or interfere with any other person's use of it;
- (f) attempt to gain unauthorised access to the portal, our systems or any data; or
- (g) use any automated means to access, scrape or extract data from the portal.
8.2 You must only upload your own resume and your own information.
9. Confidentiality and our rights over candidate information
9.1 We treat candidate details, resumes, profiles, recruiter notes and contact information as confidential, and we take reasonable steps to protect them (see clause 12).
9.2 The candidate summaries, profiles, reports and notes we create about you as part of providing recruitment services — and the collated candidate database — are prepared by us for our recruitment purposes and are our confidential and proprietary materials, subject to your rights under the Privacy Act 1988 (Cth) to access and correct your personal information (see clause 13).
9.3 Our clients and any authorised recipients are required to keep your information confidential and to use it only for legitimate recruitment.
10. Intellectual property
10.1 We (or our licensors) own all intellectual property rights in the portal and in everything that makes up our service, including the portal software and platform, our databases and candidate database, our recruitment methodologies, templates, candidate summaries and reports, our branding, and all other proprietary materials.
10.2 You are granted only a limited, non-exclusive, non-transferable, revocable right to use the portal for the sole purpose of registering your details and interacting with us about opportunities. No other rights are granted.
10.3 You retain ownership of the content you submit (such as your resume). By submitting it, you grant us the right to use, store, copy and disclose it as described in these Terms for the purpose of providing recruitment services to you.
11. Suspension or removal of your registration
11.1 We may suspend your access to the portal, or remove or close your registration, if:
- (a) you breach these Terms or use the portal improperly;
- (b) you have provided false, inaccurate or misleading information;
- (c) we reasonably suspect a security or privacy incident and need to protect the portal or the information in it while we investigate; or
- (d) we are required to do so by law.
11.2 We may suspend access to the portal during the investigation of a suspected security or privacy incident.
11.3 You may ask us to remove your registration at any time (see clause 13).
12. Data security
12.1 We take reasonable steps to protect your information from misuse, interference and loss, and from unauthorised access, modification or disclosure.
12.2 No system can be guaranteed to be completely secure, and you provide your information to us at your own risk. However, we maintain security measures appropriate to the sensitivity of the information we hold.
12.3 If a data breach affecting your information occurs, we will respond in accordance with our legal obligations, including the notifiable data breaches requirements under the Privacy Act 1988 (Cth) where applicable, and will notify affected individuals and the Office of the Australian Information Commissioner where required.
13. Privacy and your rights
13.1 We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and all other applicable privacy and data-protection laws.
13.2 We maintain a separate Privacy Policy that explains in detail how we collect, store, use and disclose candidate and client personal information through our portals. These Terms should be read together with that Privacy Policy, which is available on our website.
13.3 You have the right to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
13.4 You may ask us to remove your registration and delete your personal information. To make an access, correction or deletion request, email info@atlantisrecruitmentbrisbane.com. We will respond within a reasonable time and in accordance with the Privacy Act 1988 (Cth). We may need to retain some information where the law requires or permits us to do so.
14. Disclaimers
14.1 Registering through the portal does not guarantee that you will be offered employment, obtain an interview, be presented to any employer, or be contacted by any employer or third party.
14.2 We do not control the recruitment or hiring decisions of employers or clients, and we are not responsible for their conduct or for any employment terms they may offer.
14.3 We provide the portal and our services with reasonable care and skill, but to the extent permitted by law we do not make any other warranties about the portal or about outcomes. Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or other laws that cannot be excluded.
15. Changes to these Terms
15.1 We may update these Terms from time to time. If we do, we will post the updated version on the portal with a new effective date and version number.
15.2 The version in force at the time you submit or resubmit information applies to that submission. Please review these Terms when you register.
16. Governing law and contact details
16.1 These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.

16.3 If you are not satisfied with how we handle a privacy complaint, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
